【内容提要】戊戌维新派的“民权”说,是他们从变法角度出发,通过使“人”民族化、“契约”法纪化、“
个人”集体化、“权利”义务化的方式,改造西方“人权”理论的产物.它有超越传统“民本”思想的一面,
但由于他们据以改造西方“人权”理论的立场是新兴资产阶级立场,观点不成熟、方法不科学,所以改造也较
多地体现了阶级局限性与非科学性.PP
【英文摘要】This paper probes into the theory of civil rights proposed by leading figures of Chi
na's bourgeois reformist movement.The paper acknowledges the importance of their ideas of civil
rights in China's conceptual history of humanismand civil rights.Wich a comparison of Chinese-We
stern thoughts and at the level of legal philosophy,the paper delves into the backgrounds,modes
and experiences of leading figures of the reformist movement when transforming the western theor
y of "human rights".

中国共产党领导中国人民进行革命与建设,是中国人民争取享有真正人权的历程.社会主义的目标之一,
就是实现广泛而切实的人权.因此,开展人权思想史的研究很有必要.本文通过评析戊戌维新派的“民权”说
,旨在分析西方“人权”理论在中国近代的历史命运.
