Abstract:Pawning system is an usufructurary right system unique in China’s traditional civil law,its characteristics is always in balancing the interests and demands of both parties.Owing to “Property Law” having defined the land contracting management right as usufructurary right,it provides the application of pawning right in the circulation of land contracting management right with legal principle basis.The pawning of land contracting management right can enrich the circulation ways and kinds of land contracting management right,improve the circulation system of land contracting management right,thereby effectively promoting the circulation and solving the problem that financial supply is insufficient; in addition it can in maximum extent ensure the principle of collective ownership of rural land,so as to provide an effective tool for solving three agricultural problems.In a word as the traditional usufructurary right unique in China pawning right may play more important role in rural land circulation
