平等就业权是劳动权和平等权共同派生的一个权利,综合了生存权和发展权的基本人权特征,是一项具有社会性的重要权利.然而,就业歧视在世界范围内普遍存在,我国的就业歧视现象也日益盛行、形式多样,严重侵犯了公民的平等就业权,对社会政治、经济的发展以及社会的稳定产生了严重的负面作用.而保护公民平等就业的合法权益,是维护人权的基本要求.
本文对目前我国保护平等就业权的相关法律存在的诸多不足加以研究分析的基础上,借鉴国际公约和外国的经验,提出保护平等就业权的立法规制建议,以期促进公平就业,消除就业歧视.
