9.QUALITY/QUANTITY/WEIGHT DISCREPANCY AND CLAIMS:
If any discrepancy arises in respect of quantity or inner quality,the Buyer first lodge claim by cable or by fax with the Seller and make a formal one with supporting documents within thirty (30) days from discharging completion at destination port.If any dispute for quantity or quality (slight atmospheric rust surface is allowed) claim occurred at both parties,both parties shall agree to nominate SGS inspection or independent third party inspection and the result of SGS or independent third party inspection is to be final and inspection fee will be born at losing party account.
9.质量、数量及重量差异及其索赔
如有数量或内部质量争议,买方在目的港口卸货后30天内需电报或传真通知卖方同时附上相关正式文件.如双方均对数量或质量（允许表面微痕）持有争议,双方应同意进行SGS检查或请第三方检查,检查结果为最终结果并且双方都应接受,检查费用由责任方负担.
10.ARBITRATION:
All disputes in connection with this contract or the execution thereof shall be settled by amicable negotiation and friendly discussions between both parties.In case no settlement can be reached.The case in dispute shall be submitted for arbitration to The China International Economic and Trade Arbitration Commission in accordance with their regulations.The decision made by the Arbitration Commission shall be accepted as final and binding upon both parties.The fees for arbitration shall be borne by the losing party unless otherwise awarded by the commission.
10.仲裁
关于本合同或其执行所产生的争议应经双方友好协商解决.如双方不能达成一致,应由中国国际经济贸易仲裁委员会按其法规进行仲裁.仲裁结果应被双方所接受并且对双方有效.仲裁费用由责任方负担或由仲裁法庭指定方负担.
11.FORCE MAJEURE:
If delivery cannot be effected as stipulated in this contract owing Unforeseen accident caused by generally recognized “force majeure",the Seller shall notify the buyer immediately by cable,and airmail to the buyer the certificate of the accident issued by the government authorities or chamber of commerce at the place of such accident as evidence thereof,if the buyer requests,in the event of the force majeure causes continuing and delaying shipment beyond one month from the contracted delivery date ,the buyer shall have the option to cancel this contract and in such event no penalty shall be claimed by either party against the others.
11.不可抗力
如由公认的不可抗力原因不能正常发货,卖方应马上电报通知买方同时向买方以航空邮寄形式发送当地政府或商会关于不可抗力的正式认定书,如发货推迟合同时间一个月以上,买方可要求撤销合同,双方均不可要求赔偿.
12.OTHER TERMS：
1) Terms and conditions should be subjected to this contract even there are any contradictories with other standard contracts.
2) In case export tax in china increased before the shipment as agreed in the contract,the buyer and the seller share the loss 50%:50% and the contract unit price will increase accordingly.
12.其他
1）如有任何其他异议,以本合同为主.
2）如中国的出口税于发货前提高,按合同规定,买卖双方各承担50%的损失,合同标的单价相应上浮.
